Part 1: Introduction, Website Terms, and Account Registration

Clause 1.1 — Acceptance of Terms

Welcome to Turath Institute ("Institute," "we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of the Turath Institute website (turathinstitute.org), the Turath Institute LMS (academy.turathinstitute.org), services, and all associated educational content, courses, and materials (collectively, the "Services").

By accessing, browsing, registering for an account, or purchasing our Services, you ("User," "you," "your") acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all incorporated school policies detailed below. If you do not agree to all of these Terms, you may not access the website or use our Services.

Clause 1.2 — User Accounts, Registration, and Minors

To access purchased Services, you must create an Account. You agree to provide and maintain accurate, current, and complete information. You are responsible for all activities under your Account and for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized use.

You must be at least 18 years of age or the age of majority in your jurisdiction to create an Account and purchase our Services.

Parent/Guardian Registration for Minors:

If you are registering an account or purchasing courses on behalf of a minor student, you confirm that you are the parent or legal guardian with full authority to enter into this agreement. The adult account holder assumes full legal and financial liability for the minor's compliance with these Terms, all tuition commitments, and the Student Code of Conduct.

Part 2: Tuition, Payment, Cancellation Rights, and Refunds

Clause 2.1 — Contract Formation

These Terms become binding on you when you complete your registration and payment, or when you first access our Services, whichever occurs first. When you place an order, you will be asked to expressly acknowledge that the order implies an obligation to pay the stated sum. A contract is formed only when we confirm acceptance of your order by email.

Clause 2.2 — Consumer Cancellation Rights (Cooling-Off Period)

Consumer Scope:

This clause applies to you if you are a "consumer" as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — namely, an individual acting for purposes wholly or mainly outside your trade, business, craft, or profession.

Your Statutory Right to Cancel

You have the right to cancel this contract within 14 calendar days from the day the contract is entered into (the "Cooling-Off Period"), without giving any reason.

To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post or email). You may use the model cancellation form set out in Annex 1 below, but it is not obligatory. You must send your cancellation notice before the Cooling-Off Period expires. You can email us at support@turathinstitute.org with the subject line "Cancellation Notice."

Refund Upon Cancellation

If you cancel this contract within the Cooling-Off Period and have not waived your cancellation right in accordance with Clause 2.3, we will reimburse you all payments received from you without undue delay and in any event not later than 14 days from the day on which you inform us of your decision to cancel.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

Loss of Cancellation Right for Digital Content

By default, we will not supply any digital content (course materials, recorded lessons, downloadable resources) or begin any services during the Cooling-Off Period, so that you retain your full cancellation rights.

If you wish to receive immediate access to digital content, you must expressly request this and acknowledge that you will lose your cancellation right. This is done via the express consent mechanism described in Clause 2.3 below.

Clause 2.3 — Waiver of Cancellation Right for Immediate Digital Access

Under Regulation 37 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, we may not supply digital content during the Cooling-Off Period unless you have both:

1. Given your express consent to immediate supply; and

3. Acknowledged that you will lose your right to cancel once supply begins.

Consent Mechanism

At the point of purchase, you will be presented with a clear, separate option (on a durable medium) where you may choose one of the following:

Option A — Immediate Access (Waive Cancellation Right for Digital Content):

"I expressly request immediate access to the course materials, lessons, and digital content. I understand that once the digital content is supplied, I lose my statutory 14-day right to cancel this contract and receive a full refund. I consent to the supply of the digital content beginning immediately."

Option B — No Immediate Access (Keep Cancellation Rights):

"I do not consent to immediate access. I understand that I will not attend any classes or get access to any content for 14 days, until my cooling-off period expires, unless I later give separate express consent to waive it."

You may not select both options. If you do not select either option, Option B shall apply by default, and we will not supply any digital content or begin any services until the Cooling-Off Period has expired.

Effect of Selecting Option A:

Once we begin supplying digital content to you, you lose your statutory right to cancel this contract and receive a full refund in respect of that digital content. This does not affect your rights under the Consumer Rights Act 2015 if the digital content is faulty, not as described, or not supplied with reasonable care and skill.

Clause 2.4 — Live Classes and Services Within the Cooling-Off Period

If you wish for live classes or tuition services to begin within the 14-day Cooling-Off Period, you must expressly request this in writing. If you subsequently cancel:

• You will be charged a proportionate amount for the services already provided up to the point you cancel.

• You will receive a refund of any amount paid that exceeds the proportionate charge for services already supplied.

• This right to a proportionate refund does not affect your digital content waiver under Clause 2.3, which operates separately.

If you do not expressly request early commencement of services, no services will be provided until the Cooling-Off Period has expired.

Clause 2.5 — Term-Based Tuition Liability

Enrollment at Turath Institute constitutes a binding financial commitment to the tuition for each academic term. Monthly payment arrangements do not constitute a pay-as-you-go membership, but represent an interest-free installment schedule to settle term tuition.

Once the Cooling-Off Period has expired (or has been validly waived), and upon commencement of an academic term, tuition for that entire term becomes fully due and non-refundable, as it covers committed instructor allocations, physical venue capacity, and operational overhead. Voluntary withdrawal during an active term does not reduce or cancel liability for that term's tuition.

Liability for any subsequent academic terms is released upon written notice of withdrawal, provided written notice is given before that term begins and abides by all other terms of service. This schedule reflects a genuine pre-estimate of the Institute's losses and is not a penalty.

Nothing in this clause affects or limits your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Clause 2.6 — Late Enrollment & Course Access

Students who apply or are admitted after an academic term has commenced cannot join on a pro-rated basis. Late enrollees must pay full tuition for the active term to obtain access to current and previously delivered course materials, recorded resources, and curriculum content.

Clause 2.7 — General Tuition Policy

Due to immediate physical venue planning, seat allocation, and digital platform access, tuition fees are non-refundable once the Cooling-Off Period has expired (or has been validly waived in accordance with Clause 2.3) and once physical instruction begins or access is granted, except as expressly provided in Clauses 2.8, 2.9, and 2.10.

Nothing in these Terms affects or limits your statutory rights under the Consumer Rights Act 2015, including your right to a remedy if services are not performed with reasonable care and skill, or if digital content is faulty, not as described, or not of satisfactory quality.

Clause 2.8 — Extenuating Circumstances

While tuition is generally non-refundable after the Cooling-Off Period, we want to ensure a fair and correct purchase and operational experience.

• Extenuating Life Circumstances: Pro-rata refunds (minus a £25 administrative fee) may be granted where you provide documented evidence of a severe medical emergency or unavoidable family tragedy that prevents you from completing the term. A student's refusal or unwillingness to attend does not qualify. We will assess such requests in good faith and will not unreasonably withhold a refund.

• Wrong Course Purchased: If you accidentally purchased the incorrect class, contact us within 48 hours of purchase and before accessing or downloading significant course materials. We will exchange your enrollment for the intended course.

• Duplicate Purchase: If you were charged twice for the same class due to a system error, contact us for an immediate refund of the duplicate charge.

• Mistaken Purchase: If you made a purchase genuinely by mistake (e.g., unintended click or misunderstanding of the product), you must notify us within 2 hours of the transaction and before accessing any course content for a full refund.

Clause 2.9 — Seat Reservation Fee

A £50 Seat Reservation Fee is payable upon registration to secure the student's physical placement and cover administrative onboarding costs. This fee is earned upon enrolment and is applied toward final account settlement upon completion of the full academic year. It is not refundable on withdrawal, as it compensates the Institute for the reserved place that could not be offered to another student.

Exception: Where you cancel within the Cooling-Off Period in accordance with Clause 2.2, the Seat Reservation Fee will be refunded in full. Where you are expelled for a minor offence before the term begins, the Seat Reservation Fee will also be refunded.

Clause 2.10 — Minimum Viable Class Size & Institute Cancellation

Each class requires a minimum threshold of 10 enrolled students to operate as a standalone group. If a class is canceled or dissolved by the Institute due to low enrollment without a suitable alternative being offered, all unearned prepaid tuition fees and the £50 Seat Reservation Fee will be fully refunded.

Clause 2.11 — Class Combination and Relocation

The Institute reserves the right to modify schedules, alter physical or virtual classroom locations, or combine low-enrollment classes, specifically including the combining of classes if enrollment falls below the minimum viable size of 10 students.

If a material change to the course delivery (including combination or relocation) significantly alters the nature of the course you purchased, you may terminate this contract without penalty and receive a refund for any services not yet provided.

Clause 2.12 — Independent Academy & Exam Logistics Scope

Tuition covers instruction and academic preparation only. Turath Institute does not arrange, manage, host, or invigilate external examinations, nor does it guarantee candidate placement at third-party examination centers. Exam registration, candidate entry deadlines, and associated exam board fees are handled directly by external accredited centers and remain the sole administrative and financial responsibility of the parent, guardian, or candidate. Students sit exams strictly as private candidates.

Clause 2.13 — Financial Enforcement & Late Collections

All monthly installments must be settled by the agreed due date. Any account balance remaining past due beyond 5 calendar days will incur a late administrative fee of £25 per overdue payment. Persistent non-payment or default beyond 60 calendar days may result in immediate student suspension, account escalation to an external debt recovery service, and liability for all associated legal and collection fees added to the outstanding balance.

Clause 2.14 — How to Request an Exchange or Refund

To initiate a request for an eligible exchange or refund (per Clause 2.8), you must contact our support team:

• Subject Line: Purchase Correction: [Your Order Number]

• Required Information: Include your full name, the order number, the date of purchase, and a clear description of the issue.

We will review your request and respond as soon as possible. If approved, exchanges will be processed promptly, and refunds will be issued to the original method of payment within 10–14 business days. The Institute reserves the right to refuse a refund or exchange request if we suspect abuse of this policy, fraud, or violation of our Terms of Service.

Part 3: Intellectual Property Rights and Acceptable Use

Clause 3.1 — Intellectual Property Rights and License

All course materials, including but not limited to lesson plans, notes, recordings, slides, assessments, and any other educational content supplied by Turath Institute, are the intellectual property of Turath Institute or its licensors.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the course materials for your personal, non-commercial educational purposes only. You may not reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit any course materials without our prior written consent.

Clause 3.2 — Acceptable Use

You agree not to:

• Share your account credentials with any third party;

• Record, reproduce, or distribute any live classes or course content without our express written permission;

• Use the Services for any unlawful purpose;

• Interfere with or disrupt the integrity or performance of the Services;

• Attempt to gain unauthorised access to any part of the Services.

Clause 3.3 — Account Sharing

Account sharing is strictly prohibited. Access to the Services is granted on a per-student basis. If we reasonably suspect that your account is being used by anyone other than you (or the registered minor student), we may suspend or terminate your access.

Part 4: Student Code of Conduct

Clause 4.1 — General Conduct

All students are expected to behave respectfully towards teachers, staff, and fellow students at all times.

Clause 4.2 — Minor Offences

The following behaviours are classified as minor offences:

• Inattention / Slouching: Persistent lack of engagement (e.g., sleeping, head down on desk, drawing/doodling) that negatively affects the class environment.

• Low-Level Backchat: Muttering, sighing, eye-rolling, or mild pushback against instructions.

• Unauthorised Phone/Device Use: Using mobile phones or smartwatches during class.

• Lateness: Arriving after the lesson starts without prior notice. Two late arrivals count as one minor offence log.

Clause 4.3 — Special Educational Needs (SEN) Provision

Reasonable adjustments will be evaluated for students with declared Special Educational Needs (SEN) or documented medical conditions prior to issuing formal disciplinary logs or expulsion for minor conduct infractions.

Clause 4.4 — Enforcement Process for Minor Offences

• First Offence: Verbal correction in class followed by parent/guardian notification.

• Second Offence: Immediate student dismissal. Tuition for the current term remains due, and the £50 Seat Reservation Fee is not refundable.

Where a student is expelled for a minor offence, the Institute will refund any tuition paid for services not yet provided. The £50 Seat Reservation Fee will be refunded if expulsion occurs before the term begins.

Clause 4.5 — Attendance vs. Behavioural Conduct Standard

Attendance logs are managed separately from behavioural conduct logs. Unexcused absenteeism, persistent lateness, or unauthorized exit from premises will incur academic and disciplinary logs independent of in-class behavioural performance. Meeting attendance thresholds does not mitigate, override, or erase disciplinary logs accrued for conduct infractions.

Part 5: Parent & Guardian Code of Conduct

Clause 5.1 — Professional & Respectful Engagement Standard

Turath Institute strictly requires all parents, guardians, and official account holders to maintain a professional, respectful, and polite standard of communication with teaching staff, leadership, and administrative personnel at all times.

Clause 5.2 — Unacceptable Parent Conduct

The following behaviours by a parent or guardian are strictly prohibited and constitute a major breach of contract:

• Verbal Abuse & Aggression: Using profane, threatening, condescending, aggressive, or hostile language via messaging platforms, email, telephone, or in person.

• Harassment & Excessive Disruption: Sending repeated, excessive, or unreasonable demands that materially interfere with staff's ability to serve other families, or demanding immediate responses outside published administrative hours.

• Public Disrepute & Slander: Making false, defamatory, or damaging public claims regarding the Institute, its staff, or its leadership.

• Interference with Operations: Persistent refusal to adhere to established administrative policies, attempting to direct or prescribe operational procedures to staff, or demanding unauthorized exceptions to published terms.

Clause 5.3 — Enforcement & Termination for Parent Conduct

Parental misconduct violating Clause 5.2 will result in suspension pending administrative review. The account holder may submit a written appeal to the Institute Board within seven (7) business days of notice.

Upon confirmed termination, tuition liability follows the standard schedule in Clause 2.5: liability for the current term's tuition remains due (subject to Clause 2.2 and Clause 2.3), and future terms are released.

Where termination occurs within the Cooling-Off Period and you have not waived your cancellation right in accordance with Clause 2.3, you will receive a full refund in accordance with Clause 2.2.

The £50 Seat Reservation Fee is not refundable on termination for parent conduct, except where termination occurs within the Cooling-Off Period or before the term begins.

Part 6: Disclaimers, Limitation of Liability, and Miscellaneous

Clause 6.1 — Service Standards

We will provide the Services with reasonable care and skill, as required by the Consumer Rights Act 2015.

• Digital Content: We will ensure that digital content is of satisfactory quality, fit for purpose, and as described.

• Services: We will perform the Services with reasonable care and skill.

Nothing in these Terms excludes or limits your statutory rights as a consumer, including your right to a remedy if the Services are not performed with reasonable care and skill, or if digital content is faulty.

Clause 6.2 — Limitation of Liability

Subject to Clause 6.1, our total liability to you arising out of or in connection with these Terms shall be limited to the total amount of fees paid by you in the 12 months preceding the event giving rise to the claim.

Nothing in this clause limits or excludes our liability for:

• Death or personal injury caused by our negligence;

• Fraud or fraudulent misrepresentation;

• Any breach of your statutory rights under the Consumer Rights Act 2015;

• Any other liability that cannot be limited or excluded by law.

Clause 6.3 — Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, pandemic, government restrictions, power failures, or internet outages.

Clause 6.4 — Governing Law and Jurisdiction

These Terms shall be governed by the laws of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your home jurisdiction.

Clause 6.5 — Changes to Terms

We may update these Terms by providing you with at least 30 days' written notice.

If the changes are material, you may terminate your enrollment before the effective date without penalty and receive a refund for any services not yet provided. Continued attendance after the notice period constitutes acceptance of the amended terms.

Clause 6.6 — Complaints

If you have a complaint, please contact us at support@turathinstitute.org. We will acknowledge your complaint within 5 business days and aim to provide a full response within 14 business days.

If you are not satisfied with our response, you may refer your complaint to an alternative dispute resolution provider or to your local Trading Standards service.

Clause 6.7 — Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Clause 6.8 — Entire Agreement

These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and us. Nothing in this clause limits your statutory rights.
